A man who took part in the “Viagra for men” campaign posted online the following:
A man was sentenced today by Judge Nicholas Lofeskind.
The trial judge has found Mr Lofeskind, who works for the state-licensed Viagra pharmacy business, failed to meet his disclosure obligations and failed to disclose the Viagra for men campaign. His plea was accepted. He is due to appear in court today to appear for sentencing.
Mr Lofeskind said the men had signed the Viagra for men campaign for the past four years but had never been formally charged.
“This is a personal case and there is nothing we can do. This is a court-ordered offense. I would like to have the Viagra for men campaign and not just a court order. It is a serious offense,” he said.
Judge Lofeskind said Mr Lofeskind had “exceeded his statutory obligations” and had failed to pay disclosure obligations. “We’re not going to hold you liable for this conduct. We are going to take the case to the highest court and hold Mr Lofeskind liable.”
Mr Lofeskind is a state-licensed pharmacist. He told the trial court that he would be in court for sentencing today. He did not say he would be allowed to attend for the time being.
However, he said he had no idea what Mr Lofeskind would do if he was charged in the case. “I have never had any contact with him. He’s a very calm man. I can tell you that if he did it, he would be in trouble. I am not going to sit here and take responsibility for it.”
In a written order, a judge said Mr Lofeskind had “greatly overestimated” the risks of his actions.
“The circumstances of this case are extremely troubling and it is a major miscarriage of justice that has occurred here.”
Judge Lofeskind said Mr Lofeskind’s conduct “is a violation of the U. S. attorney’s Act, the criminal statute of limitations, and the judgment of conviction,” and that he had “not given the defense sufficient notice to disclose the facts and circumstances of this case.”
“I find it is the nature of this case that is at issue,” he said, adding that Mr Lofeskind had “greatly underestimated the consequences of his actions.”
“In this case, we’re not holding you liable for the conduct of Mr. Lofeskind. I have done everything we can to help him. We’re not going to allow this conduct to go un componentized. It is a criminal offense to knowingly violate this law,” he said.
Judge Lofeskind ordered Mr Lofeskind to pay $1,000 to his probation and costs, and to pay a further $1,000 for each day of missed court visits. He ordered him to pay $100 to the court for each of the following visits:
he missed court visit for a patient that occurred two years ago;
he missed the last day of his visit for a patient that occurred two years ago;
he missed a patient that occurred two years ago; and
he missed a patient that occurred two years ago.
All of the money was deposited in a bank account, and the order was signed by Mr Lofeskind. He was given a free-standing release from commitment. He was also ordered to pay $10 to the court for each of the other visits.
Judge Lofeskind said his order is an “impeached representation of an obligation for the defendant to pay for the treatment of the defendant’s condition.
